‘Active refugee admission policies’: towards conceptual clarity?

Presentation: A shipwreck in October 2013 off the island of Lampedusa causing the death of 366 migrants pushed the question of legal pathways to admission for persons in need of international protection as an alternative to unsafe and irregular pathways of entry to the foreground, reflected, amongst others, by the 2016 New York declaration. A plurality of terms denoting such legal admission pathways broadly describe the same policy concept: alternative legal channels for people in need of protection outside the traditional asylum system and additional to resettlement. They include labour, education and family reunification pathways as well as humanitarian admission programmes, including community sponsorship and humanitarian corridors. Building on the notion of “active refugee admission policies” (ARAP) as an analytical category providing an umbrella term for legal pathways for people in need of protection (Welfens et al. 2019), this paper aims at developing a typology of such channels to admission of refugees. In order to do that, it analyses existing policies along a number of key dimensions, including the provision of mobility options, the role of state and non-state actors in facilitating mobility, as well as the role of individual agency of persons in need of protection. Finally, the paper examines cross-cutting issues, such as selection criteria, that can account for ARAPs diverse outcomes.
