Criminal Justice and Artificial Intelligence: The Ethics of the Use of Algorithms at Sentencing

Det er en almindeligt accepteret vurdering, at tillid spiller en afgørende rolle for at kunne opretholde et velfungerende retssystem. En af de bekymringer der imidlertid ofte er formuleret i forbindelse med den tiltagende brug af kunstig intelligens (AI) i retssystemer, er, at denne teknologi risikerer at underminere tilliden til domstolenes arbejde. I oplægget vil tre spørgsmål, der vedrører koblingen mellem AI, tillid og retssystemets virke, blive adresseret:
1) Er det korrekt, som det har været anført, at man slet ikke kan have tillid til en AI, og i så fald hvad er implikationerne heraf?
2) Er der grund til at tro, at brug af AI i domstolsregi vil mindske tilliden til domstolenes afgørelser?
3) Hvilken grad af tillid bør en dommer have til en AI, når denne teknologi bruges til at træffe retlige afgørelser?
AI, Sentencing, and Trust
It is widely accepted that trust plays a crucial role in sustaining a well-functioning legal system. One concern frequently raised in connection with the increasing use of artificial intelligence (AI) in judicial systems is that this technology may risk undermining trust in the work of the courts. This presentation will address three questions concerning the relationship between AI, trust, and the functioning of the legal system:
1) Is it correct, as has been argued, that one cannot meaningfully place trust in an AI, and if so, what are the implications of this?
2) Is there reason to believe that the use of AI within the judicial context will diminish trust in the decisions of the courts?
3) What degree of trust should a judge place in an AI when such technology is used in the process of making legal decisions?
